When fighting a parking ticket, are you matching the winning defense to the parking violation?
Getting an NYC parking ticket is an experience fraught with emotion. When a member of the driving public approaches their chariot and spots that ubiquitous orange wrapper leering out from under their windshield wiper, all hell breaks loose.
Or, worse yet, what happens to your blood pressure when you receive a notice in the mail from the Evil Empire informing you that you failed to respond to a parking ticket (that you never received).
All-to-often, our emotional reaction is followed by a knee-jerk reaction of disputing the ticket online. Or, writing a letter. The response generally includes:
- A rant
- A heartfelt explanation that you were with Dorothy in Kansas on the date/time the parking ticket was issued
- The defense of, “I always pay the parking tickets I deserve”
However, these types of replies rarely include a winning defense. They never match the parking violation with the proper defense.

The respondent has been charged with violating Traffic Rule 4-08(c) by standing or parking a vehicle where standing a vehicle is prohibited by signs, markings or traffic-control devices. Respondent testifies the wrong license plate was taken on the summons but also states that the license plate was for her vehicle. Respondent does not recall parking at the location but does not offer any testimony of where the vehicle was parked instead, thus this is not a persuasive defense as a denial without any specific information about where the vehicle was located at what time is insufficient to challenge to prima facie case on the sums. Summons sustained.”

I really feel bad when a wonderful member of the driving public wastes a defense on an emotional plea for a dismissal or raises a defense that has no chance of winning.
