Taxi Stand parking ticket was dismissed
Did you ever have one of those days when nothing went right? Sadly, our heroine, Joan’s bad day was about to get worse. She returned to her chariot after a horrible day at work and found a parking ticket sticking out from under her wiper. Yikes!
Joan was charged with parking in a Taxi Stand. She was distraught. $115 parking fine because she failed to see the evil sign.
Is there anything Joan can do to beat the taxi stand parking ticket?
Taxi Relief Stand parking ticket
Joan hired me to fight the ticket. The first thing I did was to check out the parking sign/rule that regulated Joan’s parking space. The universe smiled because the sign/rule was a Taxi Relief Stand and not a Taxi Stand. Ergo, the Warrior charged her with the wrong rule.
There is a Taxi Stand Rule and a Taxi and For-Hire Vehicle Relief Stand Rule. Here are the two Rules:
(c) Violation of posted no standing rules prohibited.
When official signs, markings or traffic-control devices have been posted prohibiting, restricting or limiting the standing of vehicles, no person shall stand or park any vehicle in violation of the restrictions posted on such signs, markings or traffic-control devices, except as otherwise provided herein:
(1) Taxi stand. No person shall stand or park a vehicle other than a taxi in a taxi stand when any such stand has been officially designated and appropriately posted except that the operator of a vehicle may only temporarily stand therein for the purpose of expeditiously receiving and discharging passengers provided such standing does not interfere with any taxi about to enter or leave such stand.
(2) Taxi and/or for-hire vehicle relief stand. No person shall stand or park a vehicle other than a taxi or for-hire vehicle in a relief stand when any such stand has been officially designated and appropriately posted. The operator of a taxi or for-hire vehicle may park at such stand for no more than one hour.

Yay for the good guys! Please check out how careful I was to establish that the Taxi Stand Relief Sign regulated the place of occurrence entered on the parking ticket. Once I did that, it was clear the Warrior charged Joan with the wrong Rule.
Did you know there were two taxi type stand rules?

Wonderful observation! It’s like Miranda warnings. If not given prior to arrest, a criminal can “slip slide away.”
In Parking Ticket Land, since the Warrior isn’t required to appear in court, his testimony is contained in his entries on the parking ticket. If he charges you with the wrong rule, or misdescribes or omits any required element, he loses and you win.

Hi Larry,
I received a ticket for parking in front of a pedestrian ramp. However, the make of the car as written on the ticket is different from the actual make of the car. Is this sufficient to have the parking ticket dismissed?

Good morning.
You’re a winner. The MAKE of a car is a required element. If the MAKE is misdescribed, you win, subject to presenting the proper proof, properly.
In your case, I would submit photos of your vehicle registration and windshield sticker, if registered in NY.
If registered out-of-state, I would offer registration and photos if the MAKE of our chariot appears on the car.

I recently got a ticket for no standing taxi sign , which was recently placed. However there was a meter on the block and opposite side of street. There was also a 1 hour parking sign at middle of block … could I beat this ticket? What should be my defense ?

I would look for mistakes on the front of your ticket. If you find one or more omitted, misdescribed, or illegal required elements, you win, subject to presenting the proper proof, properly.
A taxi zone extends from the sign in the direction of the arrow (S) to the next parking sign, or if none, the end of the block. I’m afraid I don’t think the myriad signs defense will work in your situation.

I drive FHV vehicles . I was at the taxi stand sign inside the vehicle . A traffic agent just issue me a ticket of $115 . I didn’t left my car and there was no other taxi cab at that time . Do you think I can fight this ticket?

I’m sorry for the delay but I just returned from a visit with my children and granddaughter in Seattle.
I’m sorry to say that an FHV cannot park in a Taxi Stand unless it specifically permits parking for FHV also.

I recently got a ticket and a boot in NYC for parking in the hotel loading zone where I work. I had a hotel staff sign in the car window. Although I paid both, can I try to fight for a reimbursement. The ticket was $115 and the boot was $185. The agent told me I had only 2 hrs to resolve or I would be towed. Can I fight for a reimbursement?

Oh man, what a crying shame!
When you pay a parking fine, it’s considered a plea of guilty to the violation. That is to say, you lose your right to fight the ticket.
Sadly, you have to beat the parking ticket to earn a refund of the boot fee.
You have to settle the boot fee in order to gain the release of the boot. But, you do not have to pay for the parking ticket. You are still allowed to fight the ticket and if you win, you are entitled to a refund of the boot fee.

Hi Lawrence, I have a valid Parking Permits for People with Disabilities and received a summons for parking at a Taxi and For-Hire Vehicle Relief Stands.
On my permit, it states that parking at a Taxi Stand was not allowed, but nothing about a Taxi and For-Hire Vehicle Relief Stand.
Is that a valid defense?

Here’s a list of areas you cannot park with a PPPD.
In other words, NYC PPPDs do not allow parking:
In a No Stopping Zone
In a “No Standing Anytime” Zone, or “No Standing with Restricted Hours” Zone (e.g., No Standing 4pm – 7pm)
In spaces designated for Ambulances and Ambulettes
In a Hotel Loading Zone
In a taxi stand
In For-Hire Vehicle stands
In Carshare parking spaces
In a bus stop
In a Fire Zone
Within 15 feet of a fire hydrants
In a driveway or crosswalk or on a sidewalk
Or for double parking
