Use a FOIL request to get information to fight an NYC parking ticket

Joe parked his car in a legal parking space and headed into work at 8 a.m. Joe returned to his car later in the day, to find a bright, orange epistle stuck under his windshield wiper. Shock and awe followed when Joe observed the parking sign regulating his space at 8 a.m. was removed, and a brand, spanking new, parking sign installed that prohibiting standing anytime. Has this ever happened to you? Does Joe have any recourse? (Think FOIL request).

A recent NYC parking ticket law provides Joe with a free pass to beat this evil NYC parking ticket.  The big but is Joe is required to prove the date and time the brand, spanking new, parking sign was installed.

This is a perfect example of how an F.O.I.L (“Freedom of Information Law”) request to the DOT for proof of the date and time the evil, new, parking sign was installed will set Joe free.

How to make a FOIL request

Simple…

NYC DOT:

  • Click on the link,
  • Print-out the form
  • Complete the form
  • Mail it to the address on the bottom left-hand corner of the form (I recommend you send the form by certified mail, return, receipt, requested)

NYC DOF:

  • Click on the link
  • Follow the instructions to make a FOIL Request (New_after January 8, 2018)

Albany City Government loses attempt to block newspaper’s F.O.I.L. request  proving parking ticket corruption

” ‘The fact that Albany used to have two tiers of parking rules — one for people with connections, the other for the rest of us — was unfair, and I’m glad the Times Union exposed it,’ said Rex Smith, vice president and editor of the newspaper. ‘The fact that City Hall intentionally flouted state law while trying to cover up that parking fiasco, as the court has unanimously ruled it did, is shameful. I hope this sends a message to all public officials because the court is here affirming that there must be a penalty for governments that illegally conceal the truth.’ ”
