One of the standard, run-of-the-mill NYC parking violations is a no-parking ticket. Sadly, most drivers who get one of these familiar epistles pay them, “no questions asked.” But why? Too busy? Can’t win? Waste of time?
Meanwhile, is that the intelligent way to deal with a no-parking ticket?

Joe got one of those standard no-parking tickets.
An excellent client of ours got one of those “common” tickets. However, he asked Larry to check it out and see whether it was beatable.

Meanwhile, here’s the expensive piece of paper:

Be still, my beating heart
Yesiree, Larry (that’s me) checked out the place of occurrence on the NYC DOT Parking Regulations Map. Most importantly, he found that the Rule regulating the place of occurrence was a no-standing rule and not a no-parking rule. The TEA misdescribed the parking rule.
That is to say, and the TEA misdescribed a required element (the parking rule). Therefore, if we present the proper proof properly, a judge is required to dismiss the evil ticket.

Dear Honorable Judge,
I certify as follows:
I am not guilty of this no parking violation because:
-The Rule was misdescribed
A no parking rule, R.4-08(d), did not regulate the place of occurrence entered on the parking ticket, 165 Front Street, Brooklyn, NY.
Likewise, I have submitted a series of exhibits in support of my defense.
Due to these circumstances, please dismiss this parking ticket.
