Parking meter tickets are beatable

I have been writing a lot about recent changes in parking meter laws. Likewise, these significant revisions have generated many costly parking meter tickets.

Does this mean that if a driver gets a ticket, they should toss in the towel and pay the parking meter fine, “no questions asked?” No way! Meanwhile, you know me better than that.

So, what’s a driver to do?

So, let’s figure out a way to beat these meter tickets.

The required elements are a parking meter ticket gold.

I energetically recommend that you check for omitted, misdescribed, or illegible required elements every time you get an NYC parking ticket. Likewise, some unique elements have the power to beat parking meter tickets and save your hard-earned dough. For example:

  • Expired meter violations
  • Overtime meter violations
  • Time-limited zone violations

Expired meter violations

The warrior or cop must enter the “meter number” if the violation is for an expired meter. If they don’t enter the meter number, a driver is entitled to dismiss the evil ticket as long as they properly present the proper proof.

The meter number is not the zone number. Generally, a warrior or cop enters the zone number on the ticket. However, this is incorrect.

Further,

  • If time limits are in effect in a meter zone, those specific times must be accurately entered on the parking ticket in the space under the common violation name_ in DAYS/HOURS.
  • The time first observed must be entered.
  • The 5 Mn grace period must be entered in the tiny box below “Limit.”

The judge correctly dismissed the ticket because the warrior entered the zone number and not the meter number for an expired meter ticket.

  • Time first observed
  • Parking meter number

Commentary

Finding an omitted, misdescribed, or illegible required element is finding gold. Meanwhile, these tiny bits of essential information, if proven, will result in a dismissal and save you a costly parking fine. I’ve spent fourteen years urging you to:

Can you please explain what you wrote above that “The 5 Mn grace period must be entered in the tiny box below Limit.”

Is “Limit” a required element for either VC 37 or 38?

Yes. A warrior or cop must enter “5m” for “Limit” on a VC37, but not vc 38. Meanwhile, they must acknowledge that did not issue the ticket before the expiration of the 5 minute grace period.
