Can I beat status violation parking tickets in NYC?
A status violation parking ticket is about your car. These tickets are for such things as: *
- Equipment defects, and likewise
- Expired or improperly placed registration stickers
- Or, expired or improperly placed inspection stickers
- And, license plates improperly displayed
Status Violation Parking Ticket Rules
Chart
Tips
- A warrior must insert the correct expiration date of your registration on the parking ticket, or it will be dismissed upon application (For vehicles registered in NY)
- Likewise, a warrior must insert the month, and year your registration expired when the month and year appear on the plate(s) or windshield.
- You must display the front and rear plate if the state of registration requires it.
- A warrior must explain why your plate(s), inspection, or registration stickers were improperly displayed
- Above all, NY law allows your out-of-state inspection to be valid until it expires, or one year from registering your vehicle in NY
- On the other hand, the great state of NY allows a resident who purchased a vehicle out-of-state a ten (10) day grace period
- As long as you IMMEDIATELY attach your temporary sticker to get the car inspected in NY
- All subsequent “status violation” parking tickets issued on the same day for the same violation as the first “status violation” will be dismissed. But, you gotta apply for dismissal.
- A “status violation” involves the condition of your vehicle and not the location of a parking space. Therefore, a misdescribed place of occurrence does NOT entitle you to a dismissal of your parking ticket. Sorry
- You have twenty-four (24) hours from the issuance of a parking ticket for missing or damaged equipment to fix it. You are permitted to give proof of the “fix” to the PVB, and your [PARKING] ticket [MAY BE DISMISSED AT THE DISCRETION OF THE JUDGE; IF THE OPERATOR IS NOT AT FAULT]. **
Commentary
Meanwhile, do you know how many tickets warriors or cops can issue daily for status violations?
Do you know how to display the registration and inspection stickers on your car’s windshield? If not, this will help:
You must remove all previous or expired stickers before you put the new sticker on your windshield or your vehicle plate.
You must attach any windshield stickers to the lower left-hand corner of the inside of the windshield. When you see the windshield stickers from the driver seat, make sure that the registration sticker is located to the right side of the inspection sticker. Make sure that you put the sticker in a place that allows you to read the vehicle identification number (VIN) from the outside of the vehicle.
If your vehicle does not have a windshield, you must keep the windshield sticker in the vehicle.

I got 3 “status” tickets in the same day for expired registration sticker …none were dismissed…..full penalties and fines….
they booted and towed my car within 2 hours….while I was in my vehicle…for the expired registration sticker tickets….when my reg was valid and the summons that were issued for the sticker was issued when the car was not in my name.
they proceeded to also issue a “mutilated” registration sticker at 9:30 pm, by drive up Police/Traffic Van when I had left my vehicle for 5 minutes to get a cup of coffee….and no other traffic agents or van in the vicinity for 20 blocks up or all avenues each way…..
They also found me guilty for a summons that had major missing required information on it…..and am currently fighting another ticket that was never issued to me, the meter was broken and the agent called it in and said he was not issuing the summons to me…..and several other factors on the ticket were incorrect…(another fake false ticket).
I have had to pay over $2000 for summons issued to a vehicle within the last 6 months…all were direct attacks and I was not responsible for any of the summons. No one has done anything to resolve or help with any of these matters….They literally piled a bunch of shit on top of me and expect me to undig….someone in my family died and they seem to have buried me with her….and an obvious wrongful death….all on the fault of NYC and anyone involved in the parking tickets, which is the least of it….
So all your blogs and advice, obviously has not helped one bit. NYC gets to do what they want, when they want and to whomever they want to do it do and they get away with it all. I am a professional woman who has been treated as if I am a complete and utter “moron” (to say the least)…and NO ONE has helped or is helping me with anything…..
They immediately tell me to file an article 78 without even hearing the ticket to begin with. I am not filing an article 78. If I go to the supreme court, it will be for a lawsuit….of which of course, will never be heard …so again, they get away with all of it…
but thanks for your rosey colored blogs…for a city which should be condemned for all their actions and double standard garbage “rules”…and by making others pay for the expenses of the ones make those rules to suit themselves.
All in Manhattan
the mutilated registration ticket given at 9:30 pm, by a van that drove directly over to my vehicle……was because I had taped the registration back on to the vehicle….a separate police officer said the registration sticker was fine…and if it was “mutilated”, which is strong word…how could they scan the registration for the ticket?? I’m sure they will come up with an answer for that…How dare they!!! and how dare you even post these “blogs” without doing anything to prove how wrong they are. I am sure that you get responses and comments and asked for assistance by tons of people….all of whom should be signing petitions and bringing class actions against the city of NY for all that they do, especially with regards to the parking summons
Dear Mindy,
I hope publishing your comment helps in some way.
Now that you pointed all your fingers at everyone else, I’d love to take a look into what happened to you.
If you received three status violations (according to your comment, all three were for expired registrations) on the same day, you are entitled to a dismissal of the second and third expired registration parking tickets, upon applying for a dismissal of each parking ticket.
I’m happy to take a look at all three parking tickets.
Please email me copies at larry@newyorkparkingticket.com along with the defense you submitted for each parking ticket, and the judge’s decision.
Looking forward to reviewing these documents (no charge).

Larry
I received an expired inspection sticker ticket which expired on 5/31/2014. The date of the ticket is 6/3/2014. Is there a grace period that the NYS DMV allows?
Thanks for your help!!
Bruce
Dear Bruce,
Good afternoon.
I am sorry to report that there isn’t a grace period for an expired inspection.
If a warrior nabs you, even one day late, the parking ticket will stick, unless you can find an omitted, misdescribed, or illegible required element.
Best,
Larry
Is wrong location a basis for dismissal of expired registration by few days?
Guy wrote 75 street but was parked on 76
Hi Mary,
I am sorry to say that location (place of occurrence) is not a required element for status violations (expired registration). A status violation attacks your car rather than the location where you parked. If a sticker is expired, or plate not attached, it matters not where you parked your chariot.
Good luck.
Regards,
Larry
Does an expired inspection parking violation need to say the expiration date? I received 1 ticket at 3 am stating a 6/30 expiration and another ticket at 5 pm of the same day in the same location stating a 7/1 expiration.
Thanks
Dov,
Good afternoon.
If your car is registered in NY, the warrior is required to enter the month/year/date of expiration. If your car is registered out-of-state, and the month/year is displayed on the plate or windshield, a warrior is required to enter the month/year on the ticket.
If your car is registered out-of-state, and the month/year is not displayed on the plate or windshield, the warrior is required to enter “N/S” or “N/A.” The warrior should then enter the expired registration date in the comment section of the parking ticket.
The warrior is also required to enter the inspection certificate number when issuing an expired registration ticket.
If you are the unlucky recipient of a second parking ticket for the same status violation on the same day as the first parking ticket, a judge will dismiss the second parking ticket, upon submission of the proper proof.
Good luck.
Best,
Larry
Thanks for the response. My car is registered in NY. I was wondering what the correct date for the expiration date is. Is it 6/30/14 (the last day it is valid) or 7/1/14 (the first day it is invalid)?
The reason I ask is because the 1st ticket says an expiration of 7/1/14 and the 2nd ticket says 6/30/14. I understand that I can try and fight the 2nd ticket as it was the same violation, on the same day, at the same location. I am also trying to figure out if I can then fight the 1st ticket due to the incorrect expiration date.
Thank you
Dov,
What does the registration state? Doesn’t it have a month, day, and year, that it expires? If so, that’s the expiration date that must be entered on the parking ticket.
Your chariot doesn’t have to be parked in the same parking space for the second status violation to qualify for a dismissal.
Best,
Larry
Larry,
The NYS inspection stickers only have a month and year (and that is what was expired, the registration was valid throughout).
Thanks
Dov,
Please forgive an old man…I read registration when you wrote inspection. It is not easy growing old.
I would argue (never came up before) that an inspection sticker expires on the first day of the following month because if you get your car inspected on, let’s say, June 30, 2014 you are good to drive.
Sorry about my confusion.
Best,
Larry
Hello, My car is registered in NY and I recently received a parking violation
{4-08 (j)(2)} for having a “plastic cover on my plate” however there is no plastic cover on either of my plates. I do have a rear bumper guard which I place when I park it on the street but, it isn’t plastic and my plates are properly displayed. The front bumper has not guard.
Hi Jenny,
Good evening.
I’m not familiar with bumper guards…Please send me a picture of your rear bumper guard, and I’m happy to suggest a defense.
You can email your photo to larry@newyorkparkingticket.com
Best,
Larry
I’d like to use defense #8 for a 4-08 (J)(3) violation. The registration had been renewed but we forgot to put on the new sticker in time. We received 3 tickets within 3 days. How do i go about executing this strategy? The tickets are already 6 days old but are not yet in the city’s pay system online. Do i have to request a hearing? Or is there some way do it thru citypay?
Thanks!
Dear Giles,
Man, what a nightmare.
Printed parking tickets will generally show up on the the DOF website within 5-7 days. Handwritten tickets may take much longer. I do not recommend fighting parking tickets online. Speed shouldn’t trump justice.
If you want to fight one or more of the parking tickets, I suggest you fight ’em by mail. Send your certification and exhibits to the address on the back of the parking ticket by certified mail, return receipt requested.
Good luck.
Best,
Larry
I got a ticket for an expired rego sticker. You have answered some related questions in this blog but I have not been able to reach a conclusion based on them, so am asking for your opinion on this specific ticket.
I had the new sticker but hadn’t put it in the window yet. I submitted (via web) proof that the new sticker had been purchased and received prior to expiration of the old one. The response I received does not make it clear that the judge knew (or cared?) that my registration never lapsed. Do I have any recourse at this point?
Response from ALJ: The respondent has been charged with violating Traffic Rule 4-08(j)(3) by standing or parking a vehicle bearing New York plate or plates that did not display a current registration sticker. Registration after the receipt of the summons does not excuse the violation when the current sticker must be displayed. Respondent is found guilty for display of an expired sticker at the time the summons was received.
Hey Mary,
Good morning.
Great question.
Sadly, the warrior charged your car with the correct violation, (j)(3), which reads:
“No person shall stand or park a vehicle bearing NY plates unless it properly displays a current registration sticker.”
(j)(1) prohibits parking a vehicle unless it is properly registered.
Your car was properly registered, but didn’t properly display a current registration.
I don’t see any room to appeal…Sorry.
Best,
Larry
Thank you for all your help. I just got back serving in the Military and found that my younger brother drove my car out from the compound where I parked it. he received lot tickets for “No Inspection Sticker” and the ticket is over $2,200 because of of added fees. I am so confused and don’t know how to fight this. The 10 days temporary sticker I had before I left was still valid when he got about 2 of the tickets. I’d just bought the car and registered it before I went away. I would appreciate your help on this.
Dear Nos,
What a nightmare!
A couple of questions:
1. What do you mean that you left the car in the “compound?” Was it on private property? Who had access, etc.
2. How did your brother get the car keys?
Looking forward to your reply.
Best,
Larry
Yes, it was parked in my house’s parking garage (Private House). Unfortunately, I left the keys at home where he found it. However, from record, the tickets were issued on different locations where he’d parked it whenever he drove the car out. Some of them were also issued when he parked it on the street where I live while some tickets were sometimes issued everyday. In total, I see about 26 tickets issued for expired sticker with about $2,000+ due in payment. 4 is already in Judgement and I even fear my car will be booted. It’s like tickets were just being issued on the car everyday. I am so confused Sir. I just got back and actually have an appointment to get the car inspected today. I really appreciate your respond on this matter Sir. Also, I was wondering, do Judges have access to the system, to know when a car was last inspected because a lot of ideas about taking a picture of another vehicle’s sticker to show as mine has come to my mind. I am sorry I thought that way, but I am just so confuse and ideas including negative ones are coming into my head about what to do. $2,200 is a lot of money.
Nos,
Here are some tips to help you evaluate your next steps:
1. One status violation per day. If your car was issued a second or third status violation on the same day (or sometimes within 24 hours regardless of the day) the subsequent status parking tickets will be dismissed
2. Check each parking ticket for omitted, misdescribed, or illegible required elements. If you find ’em, the parking ticket will be dismissed upon application
3. Once you evaluate each parking ticket, I suggest you fight them at an in person hearing. Be honest with the judge and explain you were away serving our country. The tricky part is how your brother had access to your home and car.
The more facts you can point to that shows you prohibited him from using the car (especially since it was locked away in your garage with an expired registration sticker) the better off you’ll be.
Let us know how things worked out.
Good luck.
Best,
Larry
Thank you sir, And yes I will go with option 3 of being honest and proving that I restricted my brother from using the car. Actually my brother lives in the same house but I have my own room which was actually locked through out the time I was away. And now I just noticed that the door was previously unscrewed so I have taken pictures of the door and also taken pictures of where my car was parked in the garage. Do you think the Judge would dismiss these cases with the fact that I was not the one who did this? Is there any traffic law that justifies that especially when the tickets were issued at different locations. Thanks again for your help as I look forward to knowing if what I have is enough as evidence.
Nosa,
I am sorry to say in my humble opinion, I don’t think the defense of my brother broke into my room and stole the keys, used my car (unauthorized) and accumulated parking tickets will work.
If it were me, I’d pay a visit to the Evil Empire and participate in a in-person hearing. Tell the judge your story, and if he has some compassion, you may win.
(If all the parking tickets are in judgment, your application must be in the form of a “Request for Hearing after Judgment.” You can read about this application in our blog).
If one year or more has elapsed from the entry of default judgment, you can no longer fight them.
Good luck.
Best,
Larry
Isn’t this a “stolen vehicle” issue? Driving without consent also means (assuming there was insurance) driving without insurance. To my mind the question on this old case is whether the OP wants (or is willing) to put his brother into the NY criminal system. But a search engine query “stolen vehicle parking ticket” yields lots of hits, some of them official statements (including City of Los Angeles. Adding the words “New York” yield a bunch of interesting stories). (If the OP didn’t turn in the plates we can assume there was an insurance policy in force, or else there are other issues.) The Servicemembers Civil Relief Act probably doesn’t help here — but it is worth looking at for some status issues.
Horst,
I feel like we are long-time friends. Great thoughts…Thanks for offering some good ideas.
NYC is tough on “stolen vehicle” cases. Plus, when keys are left in the mansion and a family member uses the readily available keys to take the family members chariot for a spin, there is a presumption of authorized use and insurance remains in effect to cover any negligence of the wayward brother. The fact that the room where the keys lived was “broken into” by the brother, may be very difficult to prove. The absence of a police report is the “death knell” to persuasively establishing a stolen vehicle case.
A fair minded judge presented with a story from a returning service man may be inclined to give the service man a break.
Best,
Larry
This is years past, but I would like to offer the benefit perhaps of my own experience on Staten Island in 1990, when my ex drug addict husband and I went to parking ticket court to see a judge about the $3k tickets he had racked up while using drugs, driving my car. I was 5 months pregnant and we sat in front of the judge who dismissed a bunch along with the late fees on all of them. Then he wished us both luck. (Daughter is now 28 yrs old and we r divorced; he’s remarried and lives in Conn.) IMHO a soldier who is on active duty and his/her car is used by a wild and crazy family member is going to get a pass of some sort by a judge, simply on principal — and I am as left wing liberal as it gets so this is not a Democrat/Republican thing, it is simple common decency. Yes you may get a judge who hates the military — but where? If I was on a bench, and someone came up to me with that story, I would dismiss them all, with a stern warning to pass along to the little brother and a lot of advice abt learning from ur mistakes. God bless you for your service and maybe ur sibling will put a life together with service to his country, as you did.
Catherine,
Thanks so much for sharing your poignant story.
Very meaningful.
Regards,
Larry
I had an registration that was going to expire on Aug 01, 2014. I renewed my registration via NYC DMV’s online services on July 30, 2014. I paid for the registration renewal and received a 10-day temporary registration paper that I could print out and put on my dash while I wait for the registration sticker. It is Aug 15, 2014 now and I still have not received my registration in the mail and have received 2 tickets so far for expired registration.
What kind of recourse do I have?

Jay,
What a shame. You renew and wait, and wait, and get parking tickets.
Can you get another 10 day temporary registration paper?
Is there any chance of connecting with someone at DMV to see if the DMV offers a solution to this challenge (which I’m sure is faced by many other drivers)?
I was away from NY from August 10th -17th. My temporary registration expired August 10th, and while I was away the registration came on August 13th. I received 2 ticked the 14th and 15th. I have proof that I was away. Is there anyway I can fight this ticket, seeing as I was away during that time and could not place the registration sticker on the car?
Dear Alex,
Good afternoon.
Did you leave the car parked on the street while you were away?
Looking forward to your reply.
Best.
Larry
Yes, it was parked legally on the street, no location violation.
Alex
Alex,
Oh man, what a shame.
If your chariot is parked on the street, it is exposed to a parking ticket the NY minute a violation occurs. If the temporary sticker expired while it was parked, the ticket is valid.
But…
1. Were there any other defects on the front of the ticket?
2. When you say that you were away, was it business/pleasure or military?
Did the warrior enter the registration # in the comments section of the ticket? And, the date of expiration?
Best,
Larry
The tickets were there for 2-3 days.
I was away on business/pleasure. On one ticket registration # is there, the other just says TEMP. Date of expiration is on both.
Alex
Dear Alex,
Sorry, I’m out of ideas.
Best,
Larry
I got a parking ticket for. registration ticket mutilated (4-08 j-4)
when I had black spots on the scan bar. so it was unscannable. ticket agent wrote in comment of ticket : “motorist discolored reg sticker so it can not scan, ticket discolored”
is that considered mutilated ?
Thanks John
Dear John,
Good evening.
A “mutilated” registration is in the eye of the beholder.
Was your registration unscannable?
Best,
Larry
The registration sticker is indeed unscannable.
but no information on the sticker is unreadable or covered.
my question is, if the bar code is unreadable if it is considered legally “mutilated”
Thanks
I tried fighting the ticket. I sent in a picture of the registration sticker showing that nothing of the text of the sticker is “colored”.
and the ticket was dismissed. !
Hey John,
Way to go, Champ!
Well done.
Thanks for sharing your success with us.
Best,
Larry
Dear Larry
I received a NYC parking violation for expired inspection sticker (vtl 306 b) while my car was at a repair shop for 3 weeks. When I picked up the car it had been parked on the street and I noticed the ticket, which had been issued the previous day. I had the car inspected that same day, so the ticket was no more than 24 hours old. I submitted proof over the internet and received a decision today indicating that the fact that the car was left for repair in the shop’s care was not a defense. However, I had also included a copy of the NYS Inspection receipt as evidence. Should I appeal the decision based on the curing of the inspection violation within 24 hours?
Thanks,
Jeff
Dear Jeff,
What a shame.
I am sorry to report that there isn’t any “cure” period for an inspection parking violation. You may be thinking about minor repairs, such as a broken mirror, where you are allowed a 24-hour cure period.
Have you spoken to the repair shop about paying for the parking ticket they caused you to get? They should have known better than to leave a car with an expired inspection sticker parked on the street.
I suggest checking the front of the parking ticket for any omitted, misdescribed, or illegible required elements. For example, did the warrior enter the inspection sticker number and date of violation in the comment portion of the parking ticket? If not, you may be able to win on appeal.
Best,
Larry
Dear Larry
Thanks for such a quick response. I did not notice any defect in the Notice of Parking Violation. The sticker number and exp date are in the comments area. Is it worth submitting the appeal anyway in hopes of getting a compassionate ALJ?
Regards,
Jeff
Dear Jeff,
You’re very welcome, Jeff. I wish my reply could’ve been more helpful.
At the risk of sounding glib, I’ll leave the decision to fight a parking ticket for expired inspection by relying upon the judge’s compassion up to you.
Good luck.
Best,
Larry
Thanks again, Larry. I guess we’ll see what happens.
Jeff
My question is, if I missed one day for inspection then i passed and have a receive, will my ticket be dismissed?
Do I have a grace period?
In NYC
Hey Larry, I would like to get your opinion on my situation. I was recently found guilty at the hearing for “expired registration” (4-08(j)(3). In my defense I stated that my registration was NOT expired and that the new sticker was on the windshield at the time the summons was issued, however I accidently left the old sticker laying on the dashboard. The judge stated that it was not a defense because displaying an expired sticker is a violation even though the car was currently registered. If that is the case, then the officer should of charged me with “improper sticker” (4-08(j)(4). In addition the officer did not indicate in his comments about the old sticker on the dashboard. I believe I have grounds for dismissal because the charge or violation in question is for “expired registration” which clearly I am not guilty of due to documental evidence. I am in the process of appealing, what is your opinion on this? ..Thank you.
Dino,
Good morning.
You presented a well conceived, winning defense.
Unfortunately, your case was decided by a judge with a death grip on a guilty stamp.
On appeal, your burden of proof is to persuade the appeals panel that the original judge made a mistake of law and/or fact…Which she did.
You’ve earned a dismissal.
Please let us know the outcome.
Best,
Larry
Thanks Larry for your reply. I sure do hope the appeal panel dismisses it. By law are they suppose to dismiss it based on this defense? I mean isn’t in the law that a case has to be dismissed if the charges are different from what he or she is guilty of? I just don’t understand why the judge did not dismiss it in the first place, its clear that I am not guilty of the violation in question, and the violation that she imposes is irrelevant to my current charge (expired registration sticker).
Ok so, worse case scenario the appeal panel sustains it, what happens then? I mean its clear that it is a mistake of law, can they go against it? Wouldn’t that be a violation against them for not dismissing it?
Thanks again for feedback, I appreciate your opinion and answers. I sure will keep you and everyone posted.
Dino,
Astute observations.
The parking violation charged certainly must match the facts of a case.
If your appeal is not among the 13% of successful appeals, your next step is to file an Article 78 in adult court. Filing fees are in excess of $350 and it’s a real case. The Evil Empire knows this. An attorney will charge between $2500-$4500 to handle the case. Tough to do pro se (non-lawyer handles his own case).
Good luck.
Best,
Larry
Dear Larry,
I got a parking ticket for an expired inspection a day after my inspection sticker expired, which was at 10:22 AM. I got my inspection done the next day at 1:00 PM. Can I still get a dismissal on the ticket? If so, how do I go about it? I was told I could go to the precinct and ask them to dismiss it.
Thank you.
Dear U,
Good morning.
I always warn our clients and friends not to ask the “butcher, baker, and candlestick maker” for parking ticket advice because it is rarely right.
I am sorry to report that getting your car inspected AFTER getting a parking ticket for expired sticker does not erase the parking ticket.
The police cannot “legally” dismiss parking tickets.
You may wish to check the front of the parking ticket for omitted, misdescribed, or illegible required elements. You win, if you find one.
Best,
Larry
Good morning,
I received 2 parking tickets at the same day and time. One was for an expired registration sticker (4-08(j)3) and the other for “no match-plate/reg sticker” (4-08(j)(5). Each is for $65. As noted on the tickets, my car has California plates (with clear stickers indicating the registration month and year, which were not expired). I submitted online my dispute of both tickets (including photos), but neither was dismissed. The first ticket response uses the incorrect traffic rule as its explanation, though 4-08(h)(10). How do you suggest I move forward? Thank you in advance.
AJ,
Good afternoon.
Man, the “Dalton Gang” robbed you.
You excellent question is really beyond the scope of the blog. But, here are some tips:
1. J3 only relates to cars with NY Plates.
2. J5 relates to all vehicles, regardless of state of registry, but I trust your plates, stickers, and tags all match
You have 30 days to appeal (from the date the decision was entered, not the date you may have received it). Your burden is to persuade an appeals panel that the original judge made a mistake of law/and or fact….Which, from what you explained, he/she did.
Good luck with your appeal.
Best,
Larry
PS…Here’s a link to the application for appeal. I suggest attaching an addendum to Section C. You’ll need more space than the application provides.
I got a inspection ticket while park at a store on long island. Do I have 24 hours to get it done.
Hi Kari,
Good morning.
We are only kind of smart in NYC.
If the ticket was issued in one of the 5 Boroughs, you’re toast. The parking ticket isn’t an invitation to get it done, I am very sorry to say.
But, you may wish to check with the town/city where the ticket was issued to learn their rules about amnesty.
Good luck.
Best,
Larry
I received a ticket for “improper display of registration sticker” as the new registration sticker was on the dashboard (not yet stuck on windshield). Registration was paid on time. Is there any recourse or suitable defense?
Thanks.
Dear Carla,
Good afternoon.
What a shame.
The warrior is required to enter the reason why the registration sticker was improperly displayed in the complainant’s comment box on the ticket. If not, you win upon application.
I trust you checked the front of your parking ticket for omitted, misdescribecd, or illegible required elements. If you find one or more, you win upon application.
Otherwise, it pains me to say you may wish to pay the fine before incurring penalties.
Good luck.
Be safe out there.
Best,
Larry
Hello, I was pulled over by the NY State Police in Orange County and received a uniform traffic ticket for violating section 306B. My inspection sticker was punched for 8/14 and I received the ticket 1/28/15. In the Description of Violation section, the officer wrote: “UNINSPECTED M/V EXP: 08/2014.”
However, the registration expiration date is missing on my ticket. Is that still grounds for an automatic dismissal? I am uncertain if operating the vehicle vs being parked is of any consequence.
After thanking the officer =) I had the car inspected 10 minutes later. Should I include a copy of the passed inspection report when mailing in the NOT GUILTY plea, or should I just save it for the court?
Thank you.
Stephen
Hi Stephen,
Sorry about the painful encounter.
The little bit of expertise I possess is in the realm of NYC parking tickets.
I regret not being about to provide a answer you can count on for traffic tickets.
Good luck.

I received a NY parking summons for having a plastic cover (cover is clear, not tinted and in no way prohibits anyone from comprehending my plate #).
Obviously, with all of the snow, traffic enforcement officers are becoming desperate.
Complainant noted section 4-08 (j)(2), which reads as “valid plates must properly be displayed,” however, in the body of the summons, complainant notes, “Covered plates,” which is technically 4-08(j)(8), “Vehicle covers prohibited.”
Do you think this is grounds for dismissal if I attempt to fight the summons?
Brian,
Good afternoon.
I tip my hat to you for doing a careful inspection of the bite size bits of information on the front of a ticket that can set us free, and including the comments section in your careful review.
Your argument is Ph.D material. The comments section is full of misstatements that help us impeach the credibility of a warrior, and win cases.
I’d raise two separate defenses:
1. I would argue that when a warrior issues a ticket for improper display, he is required to explain the reason why the plate was improperly displayed. Instead of offering a reasonable explanation, she referred to a section of the rules that has nothing to do with improper display of plates.
2. I would also argue that the plate was displayed properly because…and attach photographs.
Please let us know the outcome of your good fight.
Good luck.
Best,
Larry
Thank you so much for this post!
If it were not for the advise in this column and in the comments (especially the comment above) I would not have been able to carefully construct an effective argument.
I had received a couple tickets under 408(j)(2) for plastic covers over my licence plate. I do indeed have light grey covers for aesthetic purposes but never found it to be an issue because my car is registered in Ontario, Canada where having such covers are legal.
I argued that traffic rule 408(j)(2) as it is written only applies to NYS registered vehicles and therefore my vehicle is not in violation. Also I argued that if the intention of the traffic officer was to issue a citation against my vehicle for plate covers, he should have cited traffic rule 408(j)(8).
Based on those arguments I requested a dismissal and i got it !
So thank you all for your help!
Wow! Great news, JJ. Thanks for sharing it with “The Team.”

Larry

Larry,
Thanks for this great resource – i learned a lot – the snow has certainly gotten the warriors hopping. Received 2 expired inspection tix while parked in the same place on the street – my bad – missed that it was expired – got the inspection done on the following Monday – I know from reading your blog this is not a defense.
First ticket hand written – info is all correct on both – Saturday Eve 11:12PM 2/7/15 and the next ticket electronic Sunday 7:52AM 2/8/15 -(not even 12 hours – too bad you can’t make this stuff up) how do I go about requesting dismissal of the second – technically I am guilty but this is like piling on after the play is over. Thanks in advance.
Hey Todd,
Good morning.
Thanks for your kind remarks.
I love your “piling on” analogy!
There are two schools of thought about dismissing second parking tickets for the same status violation. The wide outs will dismiss second parking tickets issued within 24 hours of the first parking ticket.
The linemen adhere to a stricter custom of requiring the second status parking ticket to be issued on the same day as the first parking ticket.
I always fight the second parking ticket for a status violation as long as it’s issued within 24 hours of the first status violation. (The parking space doesn’t matter for status violations. It simply has to be a NYC parking ticket).
I suggest fighting the second parking ticket online. Prepare a certification briefly explaining the second status violation was issued within ___________ hours of the first parking ticket while your car occupied the same space. Mention the time period of late Saturday night and early Sunday morning.
I suggest preparing a power point exhibit (1 slide) showing both parking tickets together so the judge can easily see all the details. I include a brief caption identifying the exhibit and add a few words to bolster my defense.
For example, in your case I would make sure the judge realized the first ticket was issued late Saturday night, and the second ticket was issued early Sunday morning. This shows you parked for the night and got hit helmet to helmet early Sunday morning.
Even though the parking space doesn’t matter, the fact it was the same space helps demonstrate the unfairness of it.
Please let us know how you do.
Good luck, Todd.

Larry
I received two tickets in NYC for expired inspection. I pleaded not guilty through an online hearing because the date was wrong for the inspection expiration on the ticket, but was found guilty with this verdict: “Respondent does not deny that the inspection was expired but claims that the issuer entered an incorrect expiration date. This is harmless error. The fine is imposed.”
Can I appeal? Also The second ticket was a few hours after the first one (although on the next calendar day) and I got a new inspection within 24hrs of the first ticket, so I think I can appeal at least that one (based on your article).
MC,
Good evening.
What a shame.
Is your chariot registered in NY?
You have 30 days to appeal a guilty verdict (from the entry of the decision). Your burden of proof is to persuade a 3-judge appeals panel that the original judge made a mistake of law or fact, based upon the evidence you submitted. You don’t have the right to submit new evidence on appeal.
In order to intelligently answer your questions, I would need to review your defense summary and exhibits. I’m sorry to say that this type of review is beyond the scope of the advice I can offer on the blog.

Hi my question is. … I got a ticket for a exspired registration. …. I get a ticket every time my registration exspires do to its has to be done every…. I believe it’s every 2 years and I end up forgetting about it so what I would like to know is how would I request that exspired tickets become a fix it ticket by a certain day
Heather,
Good afternoon.
Great idea.
I would start by contacting my NYC Councilperson, or my community board president to determine whether they will support your idea.
Let me know the results of your inquiries.

Hi, I received a parking ticket on an expired registration sticker. However, the registration is updated. I forgot to put the new one on the windshield, but it was kept in the car. I mailed the picture of the updated registration and tried to dispute. They sustained the summon. You mentioned that if the correct registration date is not stated on the ticket, and the date of registration expired must be entered in the comment section, otherwise it should be dismissed. Those two things, however, are not inserted on the ticket. What should I do next to get the ticket dismissed. Thank you.
Brett,
Good morning.
Sorry about your loss.
If you are issued a parking ticket for an expired registration, the warrior must enter the date the registration expired. For a registration, this can be entered in the comment section, or in the little box labeled “Exp.Date”
There are several summons you can receive. One is for an expired registration (your registration was not expired it simply wasn’t properly displayed on the windshield) or improper display of current registration (this was the correct parking violation to issue under the facts you describe).
Your next step is to appeal the decision. However, the tipping point is that you are not permitted to submit new evidence to support your appeal. Your burden of proof is to persuade an appeal panel that the original judge made a mistake of law or fact based upon the evidence you submitted to the original judge.
Good luck, Brett.

Larry
hi Larry,
I received 3 tickets, 1 each for an expired registration, inspection sticker, and the no match-plate / reg sticker violation.
My car has CT plates and has been registered there for almost 3 years (CT does not require a registration sticker on the car). When I first bought the car, we lived in NY but soon moved and I suppose have left the original NY stickers on the car which are now technically expired even though my car is not subject to NY rules anymore.
Do you think Im still subject to these fines for simply not removing the stickers off my car? I would think being legally registered in another state would be a good defense but wanted to hear your opinion on it.
thanks in advance
JT,
Good evening.
Oh boy.
Expired registration and inspection sticker only apply to chariots that are registered in NY.
Yours isn’t. The tricky part is proving it to the satisfaction of the Evil Empire.
The “No Match” violation applies to vehicles registered in any state.
Plates must match registration sticker. Your challenge is the old vestige
on your NY car on your windshield.
You’ve gotta be thoughtful about how you present the proper proof, properly to
beat these 3 nasty tickets.
Good luck.
Regards,
Larry
JT, How did you end up resolving this? I was victim of the same violation.
Thanks!
Maggie
I have my Vespa parked in front of my building but I haven’t been riding it since it’s recently been experiencing mechanical issues. Before the registration expired on 4/30/15 I had it renewed online, however it was sent to my old address prior to my move. This evening I was surprised to find a ticket in the amount of $65 for having an expired registration sticker. I am able to prove that I renewed my registration online prior to the expiration and also that I have a new address. I didn’t realize that you could be ticketed for an expired registration when the vehicle is parked. Is this worth contesting?
Tim,
Good morning.
You fell into a trap full of drivers.
I would have done the same thing, and gotten
the same ticket.
“My registration is in the mail” or on the dashboard is not a winning defense…Sorry.
Did you check for omitted, misdescribed, or illegible required elements?
Good luck.
Best,
Larry
I received a parking ticket yesterday , when my car was parked front of my home. It said my plate covered with plastic cover.
But there is no any plastic cover, only cover from outside, which there is no any glass or anything from front just plain plate just a outside rubber cover.
Can I dismissed the ticket ? This is ridiculous that issue a ticket for nothing and I don’t even know when it was giving until I come home.
Thanks
Prawarna,
Good morning.
I hear you and agree.
But, how will you prove it?
Judge’s generally reply by saying how do they know the plate looked like this at the time the ticket was issued.
Looking forward to your reply.

Larry
Hello,
I received a ticket today for 4-08(j)(6). The comments state “hole for apr improperly filled in. Hole punched in for May inspection exp 4/30/15.
Now my sticker is in bad shape because I replaced a windshield, but i bought the car last may and have a may registration and may inspection sticker. Is there anyway to lookup the inspection number online anywhere and print out the actual date of expiration? Will the court be able to?
Dino,
Good morning.
The heinous parking crime you were charged with was violating the Evil Empire’s mandate to properly inspect and properly display an inspection sticker.
It’s not about what’s online. It’s about what was actually displayed on the windshield of your car on the date/time the parking ticket was issued.
There’s nothing for a judge to look up that will help your case for this specific parking violation.
Best,
Larry
Hi just received a $65 ticket that says “no back plate”. I used a bumper bully while its parellel parked to protect my bumper from being scratched up by other cars. NY drivers are notorious for bumping cars. We all work hard for our things and want
to take care of them. It seems my bumper bully was covering most of it. But the car does have a back plate. Is there anything I can do.
Lisa,
Good morning.
I’m not sure the Evil Empire recognizes the bumper bully defense.
Here’s the rule 4-08(j)(2)
(2) Valid plates must be properly displayed. No person shall stand or park a vehicle unless it properly displays the current plate or plates issued to it. For the purposes of this paragraph (j)(2), New York plates shall not be deemed properly displayed unless they are conspicuously displayed, one on the front and one on the rear of the vehicle, each securely fastened so as to prevent the same from swinging and placed, whenever reasonably possible, not higher than 48 inches and not lower than 12 inches from the ground, and they are kept clean and in a condition so as to be readable and shall not be covered by glass or any plastic material, and the view
thereof shall not be obstructed by any part of the vehicle or by anything carried thereon. New York dealer or transporter plates issued pursuant to §415 of the Vehicle and Traffic Law shall be
deemed properly displayed if the one plate issued is placed on the rear of the vehicle as described above. New York motorcycle plates and plates from other states shall be deemed properly displayed if at least one plate is fastened on the rear of the vehicle.
If I were going to fight this ticket, I would take photographs of the bumper bully in place and explain why the bumper bully complied with each and every element of the above rule.
Good luck.

Larry
Hi Larry,
Wow, you seem to be a person of wisdom and genuinely interested in helping people navigate the NYC evil parking empire. My hat is off to you for being such a helpful person!
While visiting the “holy city” (term used very loosely) of NYC a week ago, I received 2 tickets at the same time (spaced 1 minute apart). The first for “No parking street cleaning” 4-08 (d)(1) which was a silly oversight on my part.
But the 2nd one was for improperly displayed plate with comments of: “Vehicle plate covered -Tag line covered” 4-08(j)(2). We do have a plastic cover which I use in PA on the plate where I’m from, which is completely see-thru. Nothing is covered or obscured, so I’m baffled as to what this “tag line covered” means. I took a pic on my cell the moment I read the ticket, and the entire plate is visible unless you’re vision-impaired!
Any advice for me with either of these 2 tickets? Your help and suggestions would be most welcome!
Thanks for sharing your expertise with all of us unwitting visitors who chance upon the ticket warriors of the Rotten Apple …..and all the best to you!
Dear Uncle Al,
You are way too kind…but thanks.
I would check for omitted, misdescribed and illegible required elements for both parking tickets. If you strike gold, your ticket(s) will be dismissed.
The tag line covered nasty thing is a tough one if there are no defective required elements. Normally a picture will set you free. But, I’m concerned a judge will argue that you somehow changed the look of the plate. How can you submit a photograph that a judge will believe wasn’t doctored. Therein lies the dismissal.
Good luck.
Regards,
Larry
Larry,
Thanks for the speedy reply.
So if I follow you correct, the plastic plate cover is not an issue, glad to confirm that. But then I fail to understand what “Tag line covered” means exactly, can you please enlighten me as to what the complaint is?
These tickets are machine generated and as such nothing is sloppy. Everything seems to be filled in, even along with the VIN number. The only unusual thing is for color it says OTH, and for the year it says N/S. All other things are correct as far as I can see.
Perhaps if I take multiple pics from numerous angles that may prove a point? But I need to understand what I’m trying to prove…..waiting for your help in that regard.
Thanks again…
Here’s the complete rule:
(2) Valid plates must be properly displayed.
No person shall stand or park a vehicle unless it properly displays the current plate or plates issued to it. For the purposes of this paragraph (j)(2),
New York plates shall not be deemed properly displayed unless they are conspicuously displayed, one on the front and one on the rear of the vehicle, each securely fastened so as to prevent the same from swinging and placed, whenever reasonably possible, not higher than 48 inches and not lower than 12 inches from the ground, and they are kept clean and in a condition so as to be readable and shall not be covered by glass or any plastic material, and the view thereof shall not be obstructed by any part of the vehicle or by anything carried thereon. New York dealer or transporter plates issued pursuant to §415 of the Vehicle and Traffic Law shall be deemed properly displayed if the one plate issued is placed on the rear of the vehicle as described above. New York motorcycle plates and plates from other states shall be deemed properly displayed if at least one plate is fastened on the rear of the vehicle.
J(2) refers to NY plates. Not PA plates. Isn’t that nice, Uncle Al.
But, the plates still have to be properly displayed, despite the state of origin. The rule doesn’t give as much guidance about what does and doesn’t constitute proper display to out of state plates.
Hi again,
Glad to see someone is reading my mail ….the weary get little sleep they say…..so thanks for your quick response and I apologize for my delay.
Frankly, I’m still perplexed and need to get clarity on 2 specific points so that I can reply to the ticket in a timely manor.
1) What does the “covered tag line” mean precisely? (What is a “tag line”, what does “covered” mean?)
2) What would be your suggestion as to my best defense? I’m sure you must have at least 1 phenomenal idea for me, as there is truly nothing hiding my plate from clear view as the picture I took will show.
Thanks again….
Uncle Al
Uncle Al,
1. I don’t know what “covered tag line” means.
2. You may wish to check back on my first email.
Good luck,

Larry
Hi Larry,
I received a parking summons on my motorcycle for an expired registration sticker – Shame on me, it was expired (I figured I’d have at least until the morning to go to the DMV after bringing it out of storage the night before!)
After getting the summons, I opted to renew online post-haste, which I hadn’t wanted to do before since there simply is nowhere on a motorcycle to securely display the printed temporary registration – I realize that renewing after the fact isn’t grounds for dismissal, but would articulating how I intended to renew at the DMV the same morning I received the summons so that I would receive a sticker, rather than taping a flimsy temp registration onto the motorcycle would be adequate grounds for leniency, or am I barking up the wrong tree?
Failing that – I observed that the make of the motorcycle was marked down as NS even though it’s clearly shown on both sides of the gas tank in addition to directly above the license plate in large, entirely unmistakeable, and rather permanent, from-the-factory text – would the traffic agent’s failure to observe and list the make be a dismissible error?
Additionally, although the place of occurrence is accurate (Front of an address), the precinct of occurrence is incorrect – the north side and south sides of the street are policed by different precincts, and the precinct which covers the opposite side of the street is listed on the summons, would an incorrect precinct have any bearing on my case?
Thanks,
Jack
Jack,
Good evening.
Your best defense is NS for make. The other possible defenses you raised are thoughtful, but not winning defenses…sorry.
The Evil Empire has been weird and roguish lately. There must be a memo floating around threatening the judges with unemployment unless they ignore valid defenses.
With that said, take photographs clearly showing the make displayed on the bike, submit your vehicle registration and independent proof the Make is really the Make.
Certify that the photographs show the bike as it exists when the ticket was issued.
Good luck.
Best,
Larry
Thanks for the great answer!
What would constitute independent proof for this, and is there a particular process to certifying the photos?
Jack

Hi Larry,
We received seven parking tickets for VC71 (inspection sticker expired) over the course of a twenty day period. We use our car very infrequently and didn’t see these tickets until all seven had been issued. Only three physical tickets were on our car, although we saw that seven in total had actually been issued once we searched our car in the NYC DOT website.
The tickets add up to about $500. Is there anything we can do to reduce the amount due?
Thanks,
Jen
Jen,
Oh man, sorry about that.
The “fine reduction” program was discontinued several years ago.
I would carefully examine each parking ticket for omitted, misdescribed or illegible required elements.
(The sticker number and date of expiration must be entered on VC71 tickets).
Good luck.
Regards,
Larry
Dear Larry,
I appreciate your website and comments trying to help out common folk in whatever way you can.
I just (june 3rd) received a parking ticket for expired inspection sticker. Not that it matters, it was my wife’s graduation and I was so excited that I forgot
about everything else. I parked, paid my meter, ran to the ceremony, had to come back to pay for extended parking stay, so I paid 2s for the meter. Then, when I finally come back, there is a ticket! I was a bit shocked because I knew I paid for the meter. I open it… and it’s for inspection. The warrior put 5/2 7 as expiration of inspection but that is wrong because in NY the inspection always expires on last day of a month. In this case the inspection sticker said 2015 and had circle through May, so expiration should have been 5/31 Can I fight the ticket based on this, anything else I can use? I know there is no excuses, it’s my fault, but I don’t agree the fine should be $65, I would pay lesser fine but $65 is just nuts.
Any input is appreciated, thanks!
Simon
New York
**CORRECTION** Sorry, I just double checked, and the 5/27 expiration is for my registration which is correct. The warrior did put right expiration for inspection of 5/31
So now I don’t know what to do. 10 years ago I could easily win this ticket by simply submitting copy of renewed inspection that I have done today and the ticket would have been dismissed. Today, in NYC, however, my odds are almost nil. Again, any input would be appreciated.
Simon,
What a shame.
Sorry, Simon. Nothing else to suggest unless there are other mistakes on the front of the parking ticket.
Best,
Larry
Simon,
Please extend your wife a big congratulations for her graduation. Wonderful event.
The correct sticker number and date of expiration must be entered on the parking ticket.
If not, you win upon application and presenting the proper proof.

Hey Larry,
Thank you so much for taking the time to write thoughtful responses to everyone’s cases. I was hoping you could help me.
I received a parking ticket on my motorcycle this morning for violating Section 4-08 (j) (8), which states :
Vehicle covers prohibited. No person shall stand or park a vehicle having a cover on it that obscures the make, color, vehicle identification number (VIN), license plates and/or registration and inspection stickers, and/or restricts entry to the vehicle, if such vehicle is standing or parked
in violation of posted rules.
I, like many New York City motorcyclists, have a cover on my bike to keep it safe from rain, debris, leaves, dirt, etc. I also use it as a security measure to avert thieves (I use a cover alarm, which is tripped if the cover is removed). The rear part of the cover was flipped up to reveal the license plate number, and the ticket was left there. The bike is registered in state, and the ticket has “NS” for the expiration month and day (year is shown on the plate), and vehicle model year.
Is there a good defense for this ticket? Thank you in advance.
Michael,
Good morning.
This is a tough one, Michael.
Here are some tips:
1. “NS” must also include the reason why…”NS-cover” is correct while “NS” isn’t
2. I would argue that the year was displayed on the plate and all motorcycle registrations expire on the same day of the same month…April 31, ________(year).
3. If all the other information about your bike was included, I would argue that the cover was not only removable, but it was removed to expose all the other information
I would argue stuff like that.
Let us know how you do.
Regards,
Larry
Larry,
I took your advice and fought back with the arguments you mentioned. Here was the exact content of the appeal:
1. The registration expiration date shows “NS/NS/16”. The year was displayed on the plate, but all motorcycle registrations expire on the same day of the same month; April 30th. This missing information is an oversight on the part of the ticketing officer.
2. Since the information of the motorcycle was included on the ticket, such as the license plate number, make, and color, it can be argued that not only is the cover removable, but it was in fact removed to expose that information.
3. Following claim number 2, the ticket fails to show a VIN, which could have also been exposed by removing the cover for that information.
4. For all of the fields with “not shown” information, the ticketing officer only marked “NS”, but did not include the reason why.
The final verdict is not guilty! Thank you for the advice!
Best regards,
Michael
Dear Michael,
I am absolutely thrilled. You made my day.
Congratulations, champ.
Thanks for sharing the details of your appeal.

Hey Larry,
I got a ridiculous ticket today in Queens. An officer approached my car and said the registration barcode was not clear (which I put on windshield as I received from DMV one year ago). I showed him the registration copy that has the barcode clearly shown. However, he insisted on giving me a $65 ticket and told me that “give this ticket to DMV”.
I wonder if the DMV can do anything about this. Would you please suggest me a good way to argue with it?
Thanks,
Bai
Bai,
Good morning.
What a shame.
Check for omitted, misdescribed and illegible required elements.
If you find one or more, you win upon application.
Beyond that, this is one I’d have to look to offer more advice.
Good luck.

I got “not standing” violation parking ticket for my vehicle with temporary NJ plates. The ticket has “N/A” in Exp. Date cell.
Can I beat this ticket? Do I need to keep those temp plates to prove it has expiration date on it? What I need to do in order to get the ticket dismissed?
Hi, I purchased a car and had it registered and inspected. However the dealer gave me temporary registration stickers. which expired 6/6/15. The permanent ones never came in the mail however my registration does not expire until 2/17/2017 and I still have not received a permanent sticker in the mail I went online and received a temporary to display in my window as soon as I received the ticket today 7/21/15. is there any way to dispute this ticket since I never received permanent stickers?

I just published a blog post today with the answer to your question.
Here’s the link.
I received two tickets for having an expired inspection ticket, one on 6/29 and the other on 7/13. I commute to NYC for work and my car was park in a park and ride location in Orange County, NY. The problem is that never received that first parking ticket, dated 6/29, and the only reason I found out was when I went online to pay for the 7/13 ticket I was delinquent and being charged $200 for the first ticket ($100 additional fee). I took my care to the mechanic and they are getting back to me with a a price to fix it. This care is no longer being used. I pleaded not guilty with hopes to talk to the judge and explain that I really did not receive the first ticket. Any advise?

I received 2 tickets today for registration sticker expired NYS 4-08(j)(3) and inspection sticker expired NYS 4-08(j)(6). A year ago, I bought this car from my uncle and I never had a chance go to DMV for inspection but I did register my car in NJ and everything. Is it possible that I can waived the registration sticker expired ticket because I did register my car in NJ? And also is there any points deduction associate to these two tickets? Thanks!

Larry I am so sorry to hear of your heart attack. I would keep you in my thoughts and prayers. I would love to sue the City – a class action from all of us – as I feel they are somewhat responsible because these warriors issue some ridiculous and unfair tickets to innocent law abiding citizens. Thanks for all your time and dedication to helping us all.
I am writing because I got useful information from your blog which helped me to get my ticket dismissed. Hoorah!!
I got a ticket improper display of registration yet they quoted the below for expired registration and it said in the comments sticker on the dash. well the only thing on the dash was my disability permit. There was no need for this ticket as I not at fault at all in any way – nothing was expired nor improperly displayed. Here is what I submitted.
Honorable Judge,
I humbly ask that his ticket be dismissed because of inconsistencies and incorrect information on the ticket. The information on the ticket contradicts the violation.
This ticket cited Section 4-08(j)(3) of the Traffic Laws as the violation which refers to vehicle registration sticker expired or missing.
My registration sticker was neither expired, nor was missing and was clearly visible to the Officer writing the ticket at 6.39 pm Oct 6 2015 when it was slightly dark outside. The ticket itself states the expiry date of my registration as September 27 2017 – this information was not missing nor expired and was clearly visible and properly displayed to the officer. The ticket stated my vehicle VIN number as 3459 and this is incorrect. A VIN number consists of more numbers and letters and must be in conformity with the number plate assigned.
With due diligence I renewed my registration on 17 August 2015 and immediately mounted it accordingly next to my inspection sticker. I own a special parking permit for people with disabilities and that was displayed properly on my dashboard. In view of the above I am kindly asking that this violation be dismissed because it is without merit. It contradicts itself and it is improperly written. Attached are the evidence for your perusal.
This ticket was dismissed.
I got another ticket for violating street cleaning rules. when my special parking permit was displayed. I sent a copy of the parking permit along with the ticket to the Adjudication Division and it was dismissed. Then I made 20 copies of that letter I got from them, 20 copies of the ticket circling the agent name, and 20 copies of the rules. I stapled a copy of each and took them to the Traffic Command Center in my area for their information. Since then they have never given me a ticket for violating street cleaning rules. For the ill advised and misinformed warrior I leave an enlarged copy of the rules on the dash next to the parking permit.
Dear AR,
I applaud the thoughtful actions you’ve taken to fight unjust parking tickets. You are a shining star to all of us.
Thanks for sharing your story.
Best,
Larry
Hello, I received 10 tickets this summer for an expired inspection. I was out of the country at the time and I simply forgot that the inspection was due. The car was legally parked and didn’t move for 2 months. Is there something that I can do to get these fines reduced?
Dear Michael,

I just received a ticket for “improperly displayed plate.” My car is registered in Virginia but bought in Pennsylvania. Thus, there is not license plate frame in front. In light of that, I place my front plate on the front windshield and that is the reason for the ticket. I have a valid back plate. Should I fight this? Nothing in the code describes exactly what “improperly” means.

I received a registration sticker expired 4-08(j)(3). Exp. Date is 3/4/16. I renewed the registration 1/27/16 but just procrastinating borrowing a straight razor to replace the stickers. I thought I had until midnight of 3/31/16 because of the big “3” & “16” on the registration sticker.. I NOW learned that is not the case.
Will I be able to fight the ticket by showing a copy of the registration?
Katie,
Good afternoon.
That depends on what rule the warrior or cop claimed you violated.
For example, 4-08(J)(1) requires your chariot to be properly registered…You win
However, 4-08(J)(3) requires the proper display of your registration sticker on the windshield….You don’t win.
I’m rooting for 1!
Good luck.
Best,
Larry
Hi Larry, I renewed my registration via DMV.gov online. They issue a printable temporary registration ‘paper’. The paper reads
“New York State Department of Motor Vehicles
TEMPORARY CERTIFICATE OF REGISTRATION
This certificate is not valid unless there is a corresponding NYS registration sticker affixed to the windshield.”
I did receive a ticket for expired sticker while this temp paper was visible through the windshield right next to the expired sticker. When renewing online, the DMV does not issue any stickers. They ONLY issue this temporary registration paper. Technically my vehicle’s registration was valid because I renewed online and displayed the temp registration, but also technically the sticker in on the window was expired. Since the DMV does not issue stickers corresponding with the temp registration that is printed, how in the world am I supposed to display a valid sticker until they send the sticker in the mail? Shouldn’t the temp registration paper be good enough
until the expiration of the printed date on the paper. Also the ticket the officer wrote had the expiration date of the sticker, not the temp registration, but shouldn’t the temp registration trump the expired sticker in terms of actual registration expiration?
On side note, I received location violations during the 10 day period the temp registration was displayed, and the issuing officers respected and acknowledged the temp registration, and used the date from the temp registration to input on the ticket, and did not also issue a j3 ticket. So was the officer who issued me the j3 on another day, just a lone warrior?
Dear David,
Good morning.
You present a very interesting conundrum.
I’d like to see if I can figure out what to do…
Please email me:
-Photographs of all the parking tickets
-Photograph of the temporary registration certificate
I’ll report back to you with my recommendation.
Regards,
Larry
Hey Larry, I received an expired registration sticker with the correct violation traffic rule of 4-08(j)(3), they put in the sticker # in the comments, but did not put in the date it expired. I read all your articles couldn’t figure out what my defense is for this. As I renewed it a while back way before it was expired, I just completely forgot to remove the old one and affix the new one. Please let me know what I should do.
Thanks
Hi James,
Good afternoon.
-It is sufficient if the registration expiration date is entered in the tiny box near the top of the ticket (Or, in the comment section).
-J3 is for people like you and me who forget to affix the new sticker (improper display of current sticker)
Regards,
Larry
So am I able to fight this ticket and beat it? If so, what should my defense be?
Hey James,
Based on the facts you shared with me, I don’t see a winning defense as long as the warrior entered the correct expiration date in the tiny box near the top of the ticket.
Regards,
Larry
I received a violation 4-08(j)(3), which would be for improperly displaying, but the NYC ticket says “Reg. Sticker Expired (NYS)”. Did the specifics of the rule change?
Page 114 of the nyc 2019 traffic laws seem to say that 4-08(j)(3) is refering to “valid registration sticker required”. Is this all the same thing and I’m on the hook for the ticket?
http://www.nyc.gov/html/dot/downloads/pdf/trafrule.pdf
Hi, Brian,
Good afternoon.
The rule has a double-edged sword. It requires the “proper” display of “current” registration. In essence, two separate violations.
In other words, You can’t place your expired registration on the dashboard of your chariot.
It’s gotta be a current registration sticker on the windshield to avoid a billet.
Park safely.
Regards,
Larry
Hi Larry,
I received a ticket on 5/31, and was towed for a missing inspection sticker on a small 50cc scooter. The year of the scooter is 2009, but it was written on the parking ticket as 2012.
The scooter has been inspected, and the sticker is on the fork now.
Any possibility of this being dismissed?
Thank you.
Tito,
Good afternoon.
So sorry to hear about the ticket and tow. That really s_____!
The year of your scooter is not a required element that would entitle you to a dismissal of the nasty ticket.
There aren’t any mulligans on inspection tickets…Sorry, Tito.
Larry
Hello Larry,
I received a ticket under section 4-08(j)(6) for Inspection Sticker Expired (NYS) at 01:04PM on 07/03/16.
I knew my inspection expires on 06/30/16 and thus, drive from Boston, where I work for a long 4th of July weekend trip to NYC, but not many shops were taking appointments. Finally, I got an appointment from 1 shop on 07/03/16 at 01:30PM and got my inspection done by 01:37PM.
Do you think is there a ground to dispute this ticket?
Thanks,
Amit

I got a 4-08j5 and the comment says no match plate/Reg sticker. Alternate plate #######. I bought my car out of state in Virginia but it’s registered here. They gave me temporary plates to drive it home that were valid for a month. By the end of the month they still hasn’t sent my NY plates so they gave me another temporary set which expired on the 27th. I finally got my rea plates a week or two ago. I immediately put the registration on my car but I didn’t have a screwdriver and I’ve been busy this week to change the plates. But I thought as long as I did it by the 27th I would be fine. My actual plates were right in my trunk. I see a patrol car driving by when I saw the ticket, flagged her down, and explained the situation. She said just take it to the dmv and they’ll dismiss it. Is that true?

hi larry!
thanks so so much for all your helpful info. my friend got my scooter out of the garage after months of storage over the weekend and i got ticketed on the monday. the scooter was registered, just didn’t have the sticker. also got slapped with an expired inspection sticker which i fixed the very next morning. the diligent warrior seems to have filled out all the correct info in the comments and boxes for both tickets. is there anyway out of these you think?
thanks so much for arming us with the knowledge,
poo!
oooh! i just discovered the plate type the warrior put is MCL which is marine corps league. It should be MOT – motorcycle.
will that let me free?
tks!
poo!
Eugene,
Hahaha…Yes, it will, but please be sure to present the proper proof, properly. Larry
Hey champ…Check out my reply in your subsequent comment. Larry
Hi, I recently received a ticket for an expired inspection sticker. My inspection sticker does not expire until March of 2017. I pleaded not guilty and sent in a defense letter, my valid inspection sticker, and the ticket itself. I received the judge’s decision and he has asked for more evidence or I can choose to pay the amount due, but he has not specified what evidence he wants to see. Any advice?
Hi Cindy,
Good afternoon.
I’ve received communications from the judges asking for additional evidence, but they’ve always said what evidence they need.
How did you prove your current sticker was on the windshield on the date/time the ticket was issued?
Regards,
Larry
Hello, i was giving a parking ticket for no standing. I did have temp nj plates while waiting for my nys plates to arrive since i did buy the car in nj. The ticket doesnt have the expiration date of the temp plate which is clearly visible. Can the ticket be dismissed on that alone based on your article about necessary information needed on the ticket for out of state plates?
Hi Lev,
Yes, it can. Great catch. The challenge is:
-Convincing a judge that works for the Evil Empire that the temporary NJ plates were affixed to your car when the ticket was issued.
-Convincing a judge that temporary NJ plates are the same as a registration containing an expiration date.
Normally, NJ plates do not display the registration expiration date and it is sufficient to enter NS or NA on the ticket.
Good luck.
Regards,
Larry
PS…I’m happy to take a look at photographs of your car with the temporary plates and a photograph of the parking ticket to see if we can beat it.You present a unique case. Please send your stuff to larry@newyorkparkingticket.com
Good afternoon Lawrence,
I received a ticket for an expired inspection on a Friday and had my car inspected on Monday. I once heard that if you inspect the car within 3 days of receiving the fine that it would be forgiven.
Is this true?
Sorry, Jalery…Not true. Regards, Larry
Hello, Larry!
Found a parking ticket on my windshield today and was wondering if I have a strong case to dispute and win if the cop wrote down the wrong Meter#? My parking receipt shows the correct Meter #. The cop switched the last two numbers around. Do I have a case?
Thank you!
Hi Dianne,
Good morning. Great question.
I’m having a senior moment and can’t recall whether meter number is a required element for an expired meter ticket (VC37). If it were me, I’d fight it, argue that the meter number was misdescribed and submit your receipt showing the correct meter number. I would also certify that the photograph of the receipt was a true and accurate image of the original receipt you paid for when this ticket was issued.
Good luck.
Regards,
Larry
hi, i got a ticket for expired inspection and registration. my car was parked in lawrence ny which is in nassau county. i was ticketed by a nyc police and on the ticket by county it says Q. can i fight this? the nyc does not have jurisdiction in nassau county. thank you
Hi Gitty,
Maybe the cop thought he was in Queens? Yikes!
Was it an NYC parking ticket summons? Was the place of occurrence entered on the ticket located in Queens or Nassau County?
Looking forward to your reply.

Larry
Hi Lawrence,
I was idle outside of JFK terminal 1 waiting to pick up a friend. When I saw the security person outside walking towards I signaled left and was going to move. He scans my registration and then moves to the side. I asked him what he just did and he said you might get something the mail. Is that a ticket? Or any idea what that is? I thought tickets have to be given in person? I did JUST lease this car and maybe he was curious about the temp registration sticker?
-Jack
Jack,
Good morning.
Oh man…Normally, when a warrior scans your registration it results in a parking ticket being issued to the plate. If the ticket wasn’t handed to you or placed under the wiper, then it will be mailed to the registered owner of the vehicle.
If you were not the owner of the “leased” car, the ticket will be sent to the registered owner. If it’s a finance company, bank, or leasing company, they will either pay the ticket and send you a bill including a service charge or notify you of the ticket.
If it were me, I’d search my plate online during the next 30 days to ascertain whether a ticket was issued. if so, review it for a winning defense or pay it.
Good luck.
Regards,
Larry
Hi Lawrence,
i got a ticket for expired inspection, the ticket was issued by the town’s parking enforcement (not a police officer) in the towns commuter lot. when the car was originally parked the inspections were valid.
Thanks
Marc,
Was this in NYC?
Larry
hi there,
I haven’t seen this one so I thought I would give it a shot. I received a ticket in Brooklyn for an expired inspection sticker. the sticker expired EOM May however the car was inspected in JUNE of 2016. my mechanic put the wrong sticker in last year! So I was thinking I had til June–and the day after this happened I got a reminder from the DMV by email that I have until EOM June to get the car inspected.
technically the sticker was expired, but I was within the timeframe to get a new inspection, and I did so the same day as the ticket. can I win if I fight this?
thank you,
Abby
Hi Abby,
Good morning.
What does “EOM” stand for?
Larry
sorry–End Of Month
do you have any thoughts on this? I can get a receipt from my inspection last year that shows it was completed in June. technically the sticker was expired–but my inspection was not! I think its worth a shot but I don’t know I there is certain verbiage I should use to address it.
thanks for any advice you may have.
And the DMV website says that the ticket would be between $25-50 if its within 60 days but may ticket (as the one shown above in your example) was for $65 why would that be?
Hi Larry,
do you have any advice on the above? I did get my mechanic’s receipt from June 1, 2016 when my inspection was done last year.
thank you for your help,
Abby
I have a ticket from New York because of ” improperly displayed plate.” I am from Connecticut. I have tried to pay, but I could not pay it. It is a first to have a ticket, and hopefully, it is the last time to have tickets.
Hello Larry,
Thanks for the information! I just got “Reg. Sticker Missing (NYS)” and “Inspection Sticker Missing (NYS).” I recently transferred from Maryland registration to New York registration (within the last week). There’s proof that I put the plates on yesterday. (Though the MD plates were on the car, the inspection and registration for the MD plates have not reached their expiration date. Perhaps a saving grace?) I arrived at the car as the ticket was being issued and showed the “warrior” that I had the registration and temporary inspection stickers in the glove compartment. No dice.
Is there any hope here?
Dan
Hi Dan,
Good afternoon.
Registration and Inspection tickets should only be issued to NY plates.
I’m wondering why a warrior issued these tickets to you if your chariot had MD plates.
If the MD plates were valid and current, you got yourself a defense. Make sure you
check the warrior’s comments, if any.
Good luck.
Regards,
Larry
Hi Larry,
Thanks for the quick response. My first comment was a bit unclear. I put the New York plates on my car the evening before the ticket was issued. I simply wasn’t aware that it was necessary to put the stickers on the windshield too (Maryland doesn’t have the sticker requirements). The Maryland inspection hasn’t expired, but there’s no sticker on the windshield to prove it; only a sticker on the MD license plate, which was not displayed.
Dan,
Ohhhhh…too, bad. Once you attach NY plates to your car, a current (or temporary) registration sticker or inspection sticker must be stuck to the windshield.
Once you remove a plate from your chariot, the status of the registration or inspection covering that plate means nothing.
Welcome to NY, Dan.
Regards,
Larry
Hi,
I just returned from the holidays and found that my car parked near my property is missing a plate. I also found three violation tickets said “missing plate” all within less than a week – it is possible to fight them?
Thank you
A
Alexa,
Good morning.
Sorry about the parking pain.
The tickets may be issued properly if there were no omitted, misdescribed and illegible required elements on the tickets. Required Elements
Further, only one missing plate violation can be issued on the same day. For example, you can’t get two or these nasty things on Monday…Only one per day.
Good luck.
Regards,
Larry
I received a Ticket on 10/17/17 for expired Reg Sticker at 2:32pm. I then recieved another ticket on 10/18/17 at 11:39 am. Is the law 24 hours so the second ticket can be disputed? I also receivd no Email or Letter of renewal eve though Im registered online at DMV. As soon as i saw both tickets as i have not moved my car in 2 days I printed out temp and paid for Registration. Would any judge have mercy?
Hi, Jacob,
I am not going to be answering any more blog comments until next year (January 2018). I’m going on 69 and just can’t keep up with the volume of work on the website. I am hoping that the old batteries recharge during the next few months.
Park safely.

Dear Larry,
I received a parking ticket for “Impropr Disply of Reg Stickr” 4-08(j)(3)
My expired sticker was still on the windshield, while my legit sticker was placed legibly on the dashboard.
Under the Complainant’s Comments the Warrior listed, “Expired REG affixed on windshield. Sticker on Dash.
However, the parking ticket warrior entered my renewed expiration date under the ‘EXP. Date’ box, NOT my previously expired date. Since the date entered within the ‘EXP. Date’ box lists a future date in 2019, can I enter a void defense since there is no expired date listed. If so, would you have any tips to include in my defense?
I also read on your site that “The date your inspection sticker expired must be entered in the comment section of the parking ticket”. Curious if that might apply here too.
Many Thanks,
Jan
Jan,
I am unable to reply to blog comments for the next few months. My old batteries need a recharge. Sorry, Larry.
HI Larry,
I was issued a ticket as NO INSPECTION CERT on 4/4/17. A sticker was on my vehicle but was 4 days expired. When my bill came it was $93 surcharge and $100 NYS fee. I took it to the clerk and asked that it be adjusted because it was only 4 days overdue and under 60 days, NYS max was $50. Months later the new bill was still $193. I went back to the clerk and she pulled out the ruling book and said No Inspection was $100. The officer wrote it incorrectly. I was given a court date but (now) right before the court date, I receive a letter from the court, with the officer’;s deposition, saying the judge feels I need an attorney to fight the fee and they’re taking me off the dock. The officer’s deposition states “…un inspected at the time as it was Due March 2017.” I also have my receipt for the previous year.
How can I explain to the judge the fee difference between No Inspection and Expired Inspection when he’s seen the deposition?
Hi, Sheryl, I am unable to reply to blog comments for the next few months. My old batteries need a recharge. Sorry, Larry.
Hi,
Received a ticket for expired registration, which I have but forgot to put on. I know that is no excuse but looking over the ticket the sticker number is missing. Only the expiration date is listed. Can I fight this by mail using the fact that the sticker # is missing ?
Hi, Ron,
I just returned from a visit with my children and granddaughter in Seattle and wasn’t able to reply to your excellent comment. Please let me know if you’d still like me to comment.

Hi Larry,
I received a ticket for a covered plate ..I have a clear cover over it which doesn’t obstruct anything, can i remove it and fight it?Or just pay the damn ticket ..
Thanks
Anthony
Hi, Anthony,
Good afternoon.
I do not recommend removing the clear cover.
Regards,
Larry
Would you please give a source for the requirement for the ticket to say “WHY” the registration was not displayed “properly”?
I see in RCNY 4-08(J)(1-8) that registration should be displayed in the car, http://www.nyc.gov/html/dot/downloads/pdf/trafrule.pdf
but where are the rules that say that the ticket should give the reason?
Does that law apply to the whole New York State specifically to Nassau County as well?
My new registration was on the dashboard behind the windshield and got a ticket for code 537-23i(2) “Current registration imprplry” in the incorporated village of Great neck (Nassau county) ,
on the ticket comments section, it just says “p”
the inspection Exp. is left blank.
Any ideas?
Thank you
Hi, Avi,
I’m sorry to report that I am no longer answering questions on the blog.
Just a little too much for this old guy to keep up with.
Good luck.

I received a ticket for Improper Display of Registration 4.08(j)(3). My registration was in date and sitting on the dashboard directly under where it was supposed to be stuck on the windshield (when I removed the old sticker, it left behind remnants, so I placed the new registration underneath, so that I could scrape the windshield with a blade and properly place the new sticker). The only comments are “no driver; no permit”. Can I appeal this??
Hi, Yvonne,
Good morning.
I would fight the ticket and argue that the TEA did not describe how my registration was improperly displayed.
This isn’t a slam dunk, but it does give you a fighting chance to beat it.
Let me know the outcome.
Good luck
Regards,
Larry
PS…Placing a registration on the dashboard is like waving a red flag at a bull. It doesn’t comply with the rule.
Hi,
Got a ticket for failing to adhere current registration sticker. My vehicle was properly registered; I simply forgot to attach the new sticker. Can this be beaten or should I just pay the darn thing? $100 is a lot of money for me.
Hi, Bill,
Oh man, what a shame. Failure to display registration is a fine of $65, which is still a lot of money!
I would check for omitted, missing or illegible required elements. If you find one or more, you win subject to presenting the proper proof.
Regards,
Larry
Hi Larry,
I received a ticket for improper placement of rear license plate on my delivery truck. Comment:” rear plate on rolling gate” The only NYS law reference I was able to find on line only states about no higher than 48 and no lower than 12 inches off the ground. Nothing else. I have the rear plate lighting installed near my plate (which regular cops care about during traffic stops) and no other place to put the plate designed by the manufacturer. How does this traffic officer come up with such stuff.
thanks
David.
Hi, David,
What a shame.
I’m sorry but you got me on this one.
What’s a rolling gate?
Regards,
Larry
It’s door or gate that rolls up when you open it. You can see it on the majority of commercial delivery box trucks in the city.
Hello Larry
Love your work! You’re insightful knowledge and diligence is a thing of legend.
Got a ticket recently for “improperly displayed plate” Section 4-08(j)(2). Comments: Plate on dash.
The thing is, someone REMOVED my plate in the morning (maybe scraped front of my car and it fell off). So I put it by the dash for the time being and got s ticket that same day. A few hours later I put the plate back in its place and took a picture of it. Same day that I got ticket. I was thinking of TWO ways to fight the ticket.
1: The ticket doesn’t specify WHICH plate is improperly displayed. Doesn’t say front or back plate. Is this valid grounds for dismissal as defective ticket?
2:If I send them the picture of my plate back in the proper place (the picture has a date to it, showing it was fixed the same day) as proof that i took care of it right away, is that a good defense?
And last, which of these 2 defenses should i pursue?
Hi, David,
I’m blushing. Thanks for your kind comment.
Here’s the scoop:
I am sad to say that both of the defenses you suggested aren’t real strong because:
-NYC requires plates affixed to the front and rear of your chariot. So, it doesn’t really matter which plate was on the dashboard if that meant two plates weren’t attached
-Technically, it doesn’t matter that you reattached the plate shortly after the date/time of the ticket. You’re guilty of the violation. But, I beat a ticket under similar circumstances by outlining a step-by-step listing of what I did and the time frame I did it to get the plate reattached.
I beat the ticket because I had a fair-minded judge who made a common-sense decision instead of a rogue judge who stuck to the black letter of the law
Good luck, David.
Let me know the outcome.
Regards,
Larry

Hi Larry,
I received a ticket for an expired registration on on Friday morning (I was parked in an alternate side parking Mon/Thurs 1130-1 spot). I then received a 2nd ticket on Monday morning at 730 for the same expired registration. I didn’t go back to check my car since I did not have to move it for alternate side.
In the comments on the first ticket the agent wrote “No summon visible.” The same thing was then written in the comments on the 2nd ticket along with no permit, temp reg sticker.
Do I have any chance to fight and have the second ticket removed? It’s ridiculous to receive a second ticket for the same offense, with no reason to have to move the car.
Thanks for the help
Hi, Steven,
Good morning.
The custom is to dismiss the second expired registration ticket if it was issued on the same day as the first expired registration ticket. The thinking is that the Evil Empire does not want to issue a get out of jail free card for an unlimited duration. You get one day to fix the status violation or you risk one ticket per day until you do. Cruel!
Any misdescribed, omitted, or illegible required elements on either ticket?
Regards,
Larry
I received a “no standing commercial meter zone” ticket (4-08(l)(3)(ii). The sign however does not say anything about non-commercial vehicles being considered no standing as opposed to no parking. They charged me $115. Is there any way to fight this one?
Hi, Steven,
I used to fight these stupid tickets and win, but the judges arbitrarily stopped granting dismissals based on my defense. Here’s a link to the blog post that explains the defense in detail.
Other than this defense, I would check the ticket for omitted, misdescribed, or illegible required elements.
Good luck, Steven.
Regards,
Larry
I got a parking violation ticket for not paying for metered parking. However, I did pay with the app and I realized I have paid for my friend’s car instead of mine. Few days before this incident, I was in the city with my friends and I used my parking app to pay for her parking and totally forgot to put My car back as default. So basically I have been paying metered parking for my friends car instead of mine.
But I still want to dispute because I was paying for my parking. My friend’s car wasn’t even near that parking.
Hi Gina,
Good afternoon.
I’m afraid the Evil Empire generally will not dismiss a ticket because of the unfortunate mistake you described. Of course, you can still give it a try.
I suggest you check out the front of the ticket for any omitted, misdescribed or illegible required elements. If you find one or more and present the proper proof properly, a judge will dismiss the stupid ticket.
Good luck.

Larry
Hi,
A month ago I received a $65 ticket for misplaced vehicle registration on my car’s windshield. It wasn’t misplaced, it was dangling because the glue had dried on part of it. I paid the ticket and taped it in place. Now, a few days ago, I got a $65 ticket for “sticker discolored” . It’s not, all is readable. How should I respond to this? Appreciate your suggestions.
Hi Bill,
Not nice!
What specific rule were you charged with violating? 4-08(j)(?).
Looking forward to your reply.
Regards,
Larry
Hi Larry,
The violation number for it is 4-08 (j) (4). Sticker discolored. I’m going to put a temp registration on the windshield per instructions on the DMV website. But today, I got another ticket—Covered VIN. 4-08 (j) (09). They’re piling on.
Hi Bill,
Got your reply. Thanks!
Here’s (j)(4)
(4) Improper stickers prohibited.
No person shall stand or park a vehicle bearing a New York plate or plates displaying an expired, mutilated, void, imitation, counterfeit or inappropriate New
York registration sticker.
Firstly, the rule doesn’t specifically refer to “discolored.” But, “inappropriate” can be used as sort of an unbrella term.
Nextly, in these type of cases, proof is in the eye of the beholder (judge). I would argue that:
-The rule does not even refer to “discolored.”
-The term, “inappropriate under the circumstances” is void for vagueness in that it fails to give a driver fair notice of what is prohibited or required.
-Refer to a photo and certify that it was taken shortly after the ticket was issued and shows that the sticker was not discolored.
Good luck, Bill.
Please let us know the outcome.
Regards,
Larry
